No Liability for Damages
ZX Plant Hire, its owners, employees, and affiliates are not liable for any direct, indirect, incidental, or consequential damages resulting from:

  • Delays, malfunctions, breakdowns, or defects in hired machinery.

  • Accidents, injuries, or property damage caused by improper operation of equipment.

  • Losses incurred due to project delays or financial damages.

All rentals are made at the hirer’s own risk, and it is the hirer’s responsibility to ensure proper handling, safety measures, and compliance with local laws.

Terms & Conditions

  1. Introduction

    1. These Terms and Conditions govern the use of ZX Plant Hire’s services, including the rental of construction and earthmoving equipment. By hiring equipment from ZX Plant Hire, you agree to comply with the terms outlined below.

  2. Rental Agreement

    1.  All equipment rentals are subject to availability and confirmation by ZX Plant Hire.

    2. A signed rental agreement is required before equipment is released.

    3. The hirer is responsible for ensuring the equipment is used for its intended purpose and operated by trained personnel.

  3. Rental Duration & Rates

    1. Rental periods are agreed upon at the time of booking. Any extensions must be approved by ZX Plant Hire.

    2. Rates are based on the agreed rental period and may include additional charges for extended use.

    3. Daily rates are calculated based on an 8-hour shift, and overtime charges apply beyond this limit.

  4. Equipment Condition & Maintenance

    1.  All equipment is inspected and delivered in good working condition.

    2. The hirer must perform regular checks and basic maintenance (e.g., fuel, oil, and water levels).

    3. Any damage, mechanical failure, or breakdown must be reported immediately to ZX Plant Hire.

  5. Liability & Insurance

    1. The hirer assumes full responsibility for the equipment during the rental period, including damage, theft, or loss.

    2. ZX Plant Hire provides equipment in working order but is not liable for project delays caused by breakdowns.

    3. The hirer must have adequate insurance coverage for the rented equipment and any third-party liabilities.

  6. Delivery & Collection

    1. Delivery and collection services are available at an additional cost.

    2. The hirer must ensure easy access to the delivery site.

    3. Delays in returning the equipment may result in additional charges.

  7. Payment Terms

    1.  A deposit may be required before the rental period begins.

    2. Payments must be made according to the agreed schedule, and late payments may incur penalties.

    3. ZX Plant Hire reserves the right to recover any outstanding amounts, including legal fees, if necessary.

  8. Cancellation & Refunds

    1. Cancellations must be made at least 24 hours before the rental start date to avoid charges.

    2. Refunds (if applicable) will be processed according to our refund policy.

  9. Safety & Compliance

    1. The hirer must ensure compliance with all health and safety regulations when operating the equipment.

    2. ZX Plant Hire is not liable for accidents, injuries, or damages resulting from improper use of the equipment.

  10. General Terms

    1. ZX Plant Hire reserves the right to update these Terms and Conditions at any time.

    2. All disputes will be handled under South African law.

    3. By hiring from ZX Plant Hire, you acknowledge and accept these terms.
